On May 10, 2023, representatives from the National Association for Gun Rights issued a rebuttal to the State of Illinois to the United States Supreme Court.
On May 1, Supreme Court Justice Amy Coney Barrett called for additional information from the State of Illinois and City of Naperville, calling on them to explain why they believe their “assault weapons” ban laws are constitutional.
On May 9, the state and city submitted their responses.
Lawyers for the state contended that AR-15s are not protected by the Second Amendment by arguing that they are not in common use. Therefore, these weapons are not safeguarded by the Second Amendment. For that reason, the Illinois state government believes that the state’s prohibition on “assault weapons” should stay in place.
