(DCNF)—George Washington University law professor Jonathan Turley said Monday that the evidence against the man accused of planting pipe bombs the night before the Jan. 6, 2021, riot at the Capitol building was “mounting,” negating any hope of an insanity defense.
The Department of Justice announced the arrest of Brian Cole on Dec. 4 on charges of transporting an explosive device across state lines. Turley said that Cole, like accused Charlie Kirk assassin Tyler Robinson, did not have “a good path” in court.
“There is not really a very good path for him,” Turley told “America Reports” guest co-host Gillian Turner. “It’s much like the [Tyler]Robinson defense, the evidence seems to be mounting, including incriminating statements reportedly made after his arrest. He’s not going to have a very good shot in arguing insanity, he was obviously very functional.”
“But the real takeaway from this is a warning to people ratcheting up the rhetoric and rage, these are the type of people who could be triggered by that,” Turley continued.
In court documents filed Sunday, prosecutors said that Cole said he “just snapped” and wanted to punish both political parties over the 2020 election.
“The defendant cannot rebut the statutory presumption of detention considering the extreme and profoundly serious nature of his crimes, the overwhelming evidence of his guilt, the years he has spent deceiving those around him to avoid accountability, and the intolerable risk that he will again resort to violence to express his frustration with the world around him,” prosecutors said in the filing.
“The facts and circumstances in this case compel the conclusion that there is no condition or combination of conditions that would reasonably assure the safety of the community if the defendant were released pending trial,” the filing continued.
Turley had previously commented on the arrest of Cole during a Dec. 4 Fox News appearance. The case had been unsolved for nearly five years when FBI agents made the arrest,
“I thought the most fascinating aspect of the press conference was the statement that this was a case built from old bricks, that they didn’t find anything new, and that is really – the key was there all along, and it was simply overlooked,” Turley told “America Reports” co-hosts Sandra Smith and John Roberts after a Justice Department press conference. “We’ll see if that bears out. It would be an indictment obviously of the prior administration if that were to be true. You have to commend this administration. They pledged they were going to run this guy down. They believe they have done so.”
